Terms of Sales

ARTICLE 1: OBJECT
The purpose of these Terms of Sales is, on the one hand, to inform any potential customer of the conditions and modalities under which the seller carries out the sale and delivery of the products ordered, and on the other hand, to define the rights and obligations of the parties. These conditions apply, without restriction or reservation, to all sales by Mose atelier of the products offered on its website www.moseatelier.com. Consequently, the fact for any person to order a product offered for sale on the Mose atelier website implies full acceptance of these general conditions of sale of which the Customer acknowledges having read prior to his order. The Customer, prior to placing his order, declares that he has full legal capacity, allowing him to commit to these Terms of Sales. Mose atelier reserves the right to modify these general conditions of sale at any time.
The products are sold new. Any order placed by the customer on the moseatelier.com site implies prior, express and unreserved acceptance of the Terms of Sales by the latter, to the exclusion of any other document in contradiction with these Terms and Conditions.

ARTICLE 2: SERVICES PROVIDED
The information on moseatelier.com is as accurate as possible. The information appearing on this page is not exhaustive and the photos are not contractual.
The color of fabrics and decorative items in the photos may vary slightly from reality.
The information is given subject to modifications having been made since it was put online. Furthermore, all information indicated on the moseatelier.com site is given for information purposes only, and is subject to change or evolve without notice.
The information contained on this site is as accurate as possible and the site is updated at different times of the year. However, it may contain inaccuracies or omissions. If you notice a gap, error or what appears to be a malfunction, please report it by email to the contact address themoseatelier@gmail.com, describing the problem.

ARTICLE 3: ORDER
From the moment the customer has registered his order, he is considered to have knowingly and unreservedly accepted these general conditions of sale, the prices, volumes and quantities of the products offered for sale and ordered.

Orders are placed on https://moseatelier.com. Mose atelier reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
Please note that placing a product in the basket does not ensure any reservation on this product until payment for this product has been made.
All the data provided and the recorded confirmation will constitute proof of the transaction. The sale will only be considered final after written confirmation of the order has been sent to the customer by email and after receipt of the full price.

ARTICLE 4: PAYMENT
By placing an order via the website, the customer can pay for their purchases by PayPal or by credit card, via our secure site, at the time of ordering. By validating the order, the customer authorizes the seller to debit his Paypal account or bank account for the amount relating to the price indicated. In the event of an error, or inability to debit the Paypal account or bank account, the sale is immediately automatically canceled and the order canceled.

ARTICLE 5: INVOICE
Following their order, the customer will receive the invoice with their products upon delivery.

 

ARTICLE 6: PRICE
Prices are in euros. They are all taxes included and do not include shipping costs. As part of the relocation of an order or a product to a country other than mainland France, Mose atelier reminds the customer that additional costs will be imposed. Any customs duties, other local taxes, import duties, or state taxes that may be payable will not be the responsibility of Mose atelier. It is up to the purchaser to check with the local authorities the possibilities of importing or using the products or services that he plans to transport, and to ensure that the technical and operating specifications specific to the manufacturer comply with the legislation of the country concerned. Specifically, a customer having delivery elsewhere than on French territory is required to contact the authorities of his territory for payment of any tax, royalty or remuneration due in respect of private copying or more broadly intellectual property rights. Mose atelier disclaims all liability in the event of non-compliance with the legislation of the country where the products will be introduced by the purchaser.
The prices of the goods sold are those in effect on the day the order is taken. Mose atelier grants itself the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

ARTICLE 7: TVA
TVA is not applicable. Under Art.293B Tax Code, Mose atelier is not subject to TVA.

 

ARTICLE 8: EXECUTION OF THE ORDER
Orders will be processed according to their order of arrival and Mose atelier will endeavor to respond as quickly as possible. The products will only be shipped after full payment of the order. In the event of out of stock or unavailability of the product ordered, Mose atelier undertakes to specify this on the website.

 

ARTICLE 9: DEFAULT OF PAYMENT - RESERVATION OF OWNERSHIP
The products ordered remain the property of Mose atelier until final and full payment of their price. In the case of delivery outside the European Union where the customer refuses to pay customs duties, VAT and other taxes to UPS, all return costs will be entirely their responsibility.

ARTICLE 10: DELIVERY
For a delivery address different from the billing address, the customer will specify it. Delivery is deemed to have been made upon handing over of the product to the carrier.
Transport will be by Colissimo, postage by weight with proof of deposit, delivery with tracking. The customer can track it online from the website http://www.coliposte.net upon simple request for the parcel number by email (themoseatelier@gmail.com).
Delivery costs are the responsibility of the customer and vary depending on the items ordered and the carrier chosen.
The products are shipped to the delivery address indicated by the customer during the order process, within 20 working days.
This delay may vary during promotional offers or holiday periods without this being detrimental to Mose atelier. During holidays, the shipping date will be indicated to the customer when placing their order.
In the event of late delivery by the carrier (depending on the one chosen by the customer), the customer will not be able to request compensation from Mose atelier. As well as in the event of an anomaly upon receipt (damaged, opened package, unreceived package, empty package, etc.), the customer must file a complaint with the carrier and inform Mose atelier within 2 days of receipt of the order. Mose atelier will not be held responsible in the event of delivery problems.
Any risk of loss or damage to the goods is transferred to the customer at the moment when the latter or a third party designated by him, and other than the carrier, takes physical possession of these goods.
As part of the refund, you will be refunded for the items received, less the original shipping costs. As part of a return, you will have to pay the new shipping costs, amounting to €4.99.
Delivery choice
• La Poste - Colissimo to France: Mailbox delivery. Reimbursement of €23/kilo in the event of loss/theft/damage.
• Mondial Relay – Parcels to France: Deposit at relay point. Reimbursement of €25 in the event of loss/theft/damage.
• Mondial Relay - Parcels to Belgium, Luxembourg, the Netherlands, Spain and Portugal: Deposit at a relay point. Reimbursement of €25 in the event of loss/theft/damage.

ARTICLE 11: TRANSFER OF RISKS
The transfer of risks to the customer occurs as soon as the products are handed over by Mose atelier to the carrier. The products travel at the customer’s own risk.

ARTICLE 12: WITHDRAWAL OF PRODUCTS IN CASE OF ABSENCE
If the recipient is absent during delivery, the carrier will leave a delivery notice to the delivery address indicated by the customer. The products must be collected from the address and according to the methods indicated by the carrier. In the event of non-collection within the time limit set by the carrier, the products will be returned to Mose atelier which reserves the right to reimburse the price, the shipping costs remaining the responsibility of the customer.

ARTICLE 13: FORCE MAJEURE
Expressly considered as cases of force majeure, in addition to those usually retained by the jurisprudence of French courts and tribunals, total or partial strikes, internal or external to the company, blockage of means of transport or supply for any reason whether, government or legal restrictions, computer failures, blocking of telecommunications including networks and in particular the Internet. The occurrence of a case of force majeure will initially automatically suspend execution of the order. If beyond a period of three months, the parties note the persistence of the case of force majeure, the order will be automatically canceled, unless otherwise agreed by both parties.

 

ARTICLE 14: RETURNS AND WITHDRAWAL
In accordance with the provisions of article L.121-21 of the Consumer Code, the customer has a withdrawal period of 14 days from receipt of the products to exercise his right of withdrawal, without having to provide reasons. nor to pay any penalty, with the exception of return costs. Returns must be made in their original condition and complete no later than 14 days following communication of the decision to withdraw. In this context, the customer's responsibility is engaged. Any damage suffered by the product on this occasion may be likely to create a failure of the right of withdrawal.
Only the price of the products purchased will be refunded. Returns must be made to Mose atelier – Louise Monin, 12 rue de Chily, 10280 Saint Mesmin, France. This right of return can only be accepted for complete products, in their original, new packaging and accompanied by a copy of the order or related elements. Items returned incomplete, damaged or used will not be taken back. The conditions for returning an item will be for incorrect size or quality defect. Any other reason will be judged as not justified. Following the return, the customer may request a refund or exchange.
To exercise their right of withdrawal, the customer must express their unequivocal desire to withdraw by sending an email to the following address: themoseatelier@gmail.com.
The costs related to the return of the product concerned are the sole responsibility of the customer.
When the right of withdrawal is exercised and subject to the correct return of the product, Mose atelier will reimburse the sums paid to the customer, within 14 days following receipt of the order and via the same means of payment as that used during the order.
Despite the care taken when preparing orders, an item may arrive damaged. The customer will therefore have 24 hours to notify Mose atelier by email after receipt of the item and request an exchange or refund. After this period, Mose atelier cannot be held responsible for the defective item and/or provide a refund.
Please note, no personalized item will be returned, exchanged or refunded.

ARTICLE 15: PERSONAL INFORMATION
The personal information requested from the customer is essential for the processing, delivery of orders and preparation of invoices. Mose atelier undertakes to never communicate this information. The information collected by Mose atelier during any customer order is necessary for the management of their order. In accordance with the Data Protection Act number 78-17 of January 6, 1978, the customer has the right to access, rectify, oppose and delete data concerning him from Mose atelier.

 

ARTICLE 16: ENTIRE CONTRACT
No other general or specific conditions communicated by the customer may be integrated into or deviate from these general conditions.

 

ARTICLE 17: DISPUTE AND COMPETENT JURISDICTION
This contract is subject to French law. Any dispute, regardless of the place of delivery, which could result from the interpretation or execution of these general conditions of sale will be submitted to the competent courts within the jurisdiction of the French courts.
